Mueller Sports Medicine announces it has successfully enforced its patent and trademark rights in Germany against 1000 Mile Sportswear Ltd, d/b/a Ultimate Performance.

The Prairie du Sac, Wisc, provider of athletic and sports medicine products, sued 1000 Mile in Germany for infringement of Mueller’s European patent rights by 1000 Mile’s Ultimate Performance knee products marketed and sold in Germany. Mueller prevailed, and the German court enjoined 1000 Mile from further infringement and awarded Mueller both damages and attorney fees. (District Court Munich I, Case No. 21 O 2599/13 in Germany)

In a separate lawsuit in the UK, per a separate news release, Mueller is seeking to collect both damages and attorney fees from 1000 Mile(Case No. IP-2016-000203 in the High Court of Justice, Chancery Division, Intellectual Property Enterprise Court).

“For more than 50 years, Mueller has invested in research and development of its portfolio of innovative sports medicine products that our customers demand,” says Brett Mueller, president of Mueller Sports Medicine, in the release. “And, Mueller Sports Medicine has a history of defending its intellectual property.”
